The renovation FILTER only controls the display of what has been set already. You use the DEFAULT setting button to control the object when you're drawing. If you've got it set to Existing, then anything you draw will end up as Existing. And BTW, you can use these same default buttons to CHANGE the phase of an element.

So they will have the status of whatever they were drawn as. They were drawn with the Demo Default button on. You can do a shift-A in a 3D view and select everything in the model, and change to Existing. (unlock all layers, of course) Will take about 10 secs. Then make sure the default button is set to Existing before you draw anything else. Then pick everything that will be demolished and press the Demo Default Button. Change the default button to New when you start drawing the new construction.
It's possible that these were drawn with the Demo Status on. If you are eyedroppering things, the Status is probably getting picked up, too.

You need to turn on the Renovation Palette. (It is under the Window menu). The Renovation drop-down menu only controls the DISPLAY. You cannot control what status an object is placed on with it.
