Thanks buddy, I knew it was right under my nose some where.
Just so I don't pul a bone head move, are the layers without a check the one I can safely delete and not worry about deleting actual drawing information (in other words I would only be deleting unused layers by deleting the layers WITHOUT a check mark)?
Also, any layer assigned to a tool's default settings will have a check mark. For example, if the wall tool is set to "Exterior Walls" layer, a check mark will appear next to this layer, even if there are no elements on this layer.
